Statement by Central Election Commission of the Republic of Azerbaijan

At the result of ethnic cleansing implemented in these areas by Armenia that occupied the territory of Nagorno Karabakh and the surrounding regions of the Republic of Azerbaijan, more than a million Azerbaijani people were displaced from these lands, as well as their historical homelands in Armenia. Since the ends of XX century which is regarded as century of victory upon fascism, occupation, genocide and alike violences, Armenia have killed cruelly babes, children, women and the olds by committing unseen violences and recalled the memory of the world publicity, thousands of people were taken as prisoners and hostages and committed Khojali genocide.
The fact of a large part of the territory of the Republic of Azerbaijan is under occupation of the armed forces of Armenia, the existence of separate regime in the upper part of Karabakh and the implementation of ethnic cleansing by Armenian political leadership was recognized by international organizations, as well as the Parliamentary Assembly of the Council of Europe (Resolution № 1416/2004/).
Armenia showed indifference to the wholly adopted principles and norms of international law, international publicity and democratic world and didn’t want to free the Azerbaijani territories occupied by itself without any term and to implement the existing resolutions by the Security Council of UN. Contrarily, Armenian authority intended to make legal its invasion, by violating basic human rights and freedoms of the citizens of the Republic of Azerbaijan and made efforts to form separate body, create air of elections. And now, the invader forces intend to re-conduct "parliamentary elections” in false republic on May 23.
This election game to be conducted in the occupied territories of Azerbaijan is fully contrary to international legal norms, Constitution of the Republic of Azerbaijan and its laws, it leads to confuse the international publicity and world states which already understand the real essence and reasons of the invasion by Armenian political authorities and making obstacles upon the peace negotiations.
Pursuant to the Constitution of the Republic of Azerbaijan, no social group, organization or individual may usurp the right for execution of power. Elections and referendum shall be conducted within the Republic of Azerbaijan only according to the Constitution and Election Code of the Republic of Azerbaijan.
Central Election Commission welcomes the position and statements of international agencies, as well as Council of Europe, OSCE and its Minsk Group, besides individual states not to recognize the false elections and the fact that it may harm the salvation of the conflict in the way of peace.
Central Election Commission of the Republic of Azerbaijan states that the representatives who are involved in "elections” in the false organization and who disguised as "observers” will violate norms and principles of international law related with their activity in the occupied territories, as well as the laws of the Republic of Azerbaijan.
The source of state authority in the Republic of Azerbaijan constitutes the will of people in elections conducted via independent, secret, private voting through general, equal and direct election rights. The Azerbaijan state ensures free expression of the will of its citizens through the protection of the principles and norms of election rights.
Central Election Commission of the Republic of Azerbaijan states that elections and referendum in the occupied areas may be conducted only after setting free these lands from occupation, restoring the territorial integrity of Azerbaijan and after the people who lived in these areas return to their native homes, according to the Constitution and laws of the Republic of Azerbaijan.
Being sure of the international community takes the same position, Central Election Commission of the Republic of Azerbaijan does not recognize and considers illegal such "elections” intended against sovereignty and territorial integrity of the Azerbaijan state.
