Seminar-conference on judicial resolution of election disputes held in Ganja

In accordance with the educational program of the Central Election Commission regarding the early Elections to the Milli Majlis of the Republic of Azerbaijan, appointed to September 1 of this year, the next regional seminar-conference dedicated to the court jurisdiction of election-related disputes within the frame of a joint project with the Supreme Court and Courts of Appeal was held in Ganja.

Mr. Ramiz Ibrahimov, Member of the Central Election Commission, Mr. Toghrul Ali, Chairman of the Ganja Court of Appeal, judges of the regional appeal court and the chairmen of the district election commissions took part in the seminar-conference.

Mrs. Naila Asgarova, Member of the Central Election Commission, spoke about the principles and features of investigating complaints and appeals in election commissions regarding the violation of citizens' electoral rights in the Elections to the Milli Majlis of the Republic of Azerbaijan.

It was reported that the complaint can be submitted in two forms - administratively or judicially. The decision of the Constituency Election Commission can be appealed to the Central Election Commission, and the decision or action (inaction) of the Central Election Commission can be appealed to the Court of Appeal. The Election Code also defines specific time limits for complaints. Thus, interested persons can appeal within 3 days from the date of publication or receipt of the contested decision. Appeals against the decisions of election commissions shall be investigated by the courts within 3 days, if less than 30 days are left before the voting day, within 2 days (but not later than the day of voting), as well as directly on voting day and after that day. An appeal against the court decision to the higher instance court can be filed within 3 days.

Also at the seminar, the Chairman of the Criminal Collegium – Mr. Rafig Jafarov spoke on the topics "Responsibility for the violation of the electoral rights of citizens" and the Chairman of the Administrative Collegium – Mr. Rashad Mamedov presented on "Proceedings in cases related to the protection of electoral rights in court".

At the end, opinions were exchanged regarding the judicial settlement of election disputes, and the event was ended after the discussions.
